1. General principles
These General Terms and Conditions of Sale (GTCS) govern all sales of products and related services by MMF Protection et Sécurité, located at 672 rue des Mercières, 69140 Rillieux-la-Pape, in mainland France and Corsica. All orders placed with MMF Protection et Sécurité implies unreserved acceptance of the General Terms and Conditions in force on the date of the order. The customer expressly waives his own terms and conditions of purchase or any other commercial document, unless expressly accepted in advance by MMF Protection et Sécurité. Acceptance of the GCS applies to the order in question and to all subsequent orders, unless new conditions are notified. The fact that MMF Protection et Sécurité s failure to invoke any of the GCS at a given time shall not be construed as a waiver of its right to do so at a later date. These GCS are governed by French law, and any dispute shall be subject to the exclusive jurisdiction of the French courts.
2. Order processing
On receipt of the order, the purchaser will receive an e-mail confirmation indicating the prices and availability of the products ordered. In the absence of notice to the contrary from the purchaser, the products, packaging, prices and conditions mentioned in the order document are binding MMF Protection et Sécurité will be contractually binding. The packaging of each product is proportional to the price indicated on the website of MMF Protection et Sécurité. Any change in packaging will result in a corresponding change in price. The products available for sale are those shown on the website of MMF Protection et Sécurité, reserves the right to modify the product range at any time. The characteristics, dimensions, weights, photos and graphic representations specified in these publications are for guidance only. MMF Protection et Sécurité reserves the right to replace the product specified in the order, even after receipt of the order, without affecting the essential characteristics of the product.
3. Price
All prices indicated on MMF Protection et Sécurité prices are exclusive of tax (HT) and inclusive of all taxes (TTC), in euros, for delivery in mainland France. Prices quoted on the website and other promotional documents are for information only. Discounts granted to the purchaser will not necessarily apply in the event of a subsequent price reduction. Discounts may only be used in conjunction with other commercial promotions or discount offers with the supplier's agreement.
4. Terms of delivery
Delivery time : Delivery deadlines and, where applicable, performance deadlines for associated services are specified in the offer or at the time the order is placed. Penalties for late delivery are excluded. The order confirmation from MMF Protection et Sécurité will inform the purchaser of any items that are out of stock. A partial delivery of the order may be considered at the buyer's request. In the case of payment by cheque, delivery will only be made 10 days after receipt of the cheque.
Non-catalog items and services : All non-catalog items and services will be subject to an additional quote or a specific agreement with an indication of the foreseeable delivery time.
Delivery charges : Delivery charges correspond to the actual costs of our various carriers.
5. Transfer of ownership and risk
In accordance with the law, the transfer of risk takes place upon dispatch. Goods ordered travel at the recipient's risk, whatever the method of shipment. If the purchaser changes his/her mind or makes a mistake, he/she has 14 days from receipt of the order to return the unsuitable product, carriage paid, in its original packaging and in new condition. Only items listed on the MMF Protection et Sécurité can be reimbursed. This provision does not apply to personalized or non-catalog items, or items ordered at the express request of the purchaser. No returns will be accepted without the prior agreement of our customer service department, which can be contacted on 04 78 00 00 25 or at the following e-mail address: mmf@mMF.fr. If the returned product is not in its original condition, MMF Protection et Sécurité reserves the right to apply a discount to the refund according to the following rules: if the original packaging is damaged, the product will only be refunded at 50% of its value; if the product proves to be unusable, it will not be subject to any refund. In accordance with the provisions of article L.221-28-3° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of goods made to the consumer's specifications or clearly personalized or which, due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly. Consequently, the customer will not benefit from the right of withdrawal concerning personalized products sold by MMF Protection et Sécurité.
6. Transport claims
No claim will be accepted if it is not made to our Customer Service at 04 78 00 00 25.
It is up to the Buyer to provide any justification to this effect.
In accordance with article L.133-3 of the French Commercial Code, it is the Buyer's responsibility to check the delivery.
In the event of damage or missing packages, it is the responsibility of the Buyer to make all necessary, precise and detailed observations (item concerned, type of damage noted, etc.) on the delivery note in the presence of the delivery person, and then to confirm them in writing to MMF Protection et Sécurité. This must be done by registered mail or by email to the following address : mmf@mMF.fr, within a maximum period of 48 hours after receipt.
The Buyer must also check that the package received still bears the guarantee strip (seal) MMF Protection et Sécurité), guaranteeing that it has not been opened or repackaged.
Important information: Without respecting this procedure, MMF Protection et Sécurité reserves the right to refuse any compensation or replacement of defective goods. In case of doubt, it is sometimes preferable to refuse the parcel than to accept it without indicating appropriate reservations.
7. Payment
Unless expressly agreed otherwise by the company, payment is due when the order is placed. Payment may be made by the following methods: cheque, bank transfer, credit card, postal order or via PayPal.
8. Warranty and returns
In accordance with current legislation, products sold by MMF Protection et Sécurité are covered by legal warranties, in particular the warranty against hidden defects provided for in articles 1641 et seq. of the French Civil Code.
Some specific equipment may benefit from additional warranties defined in the product data sheet or documentation supplied.
In the absence of a specific agreement, the transport costs associated with the return and reshipment of the defective product are at the customer's expense.
The return of defective items and products is accepted on the express condition that you first contact our sales department (mmf@mMF.fr) or our after-sales service (sav@mMF.fr) to explain the problem and validate the request. If necessary, the item or product may be replaced if it is under warranty, or repaired if it is no longer under warranty (a quote will be established).
9. Liability
Unless otherwise required by law :
- The responsibility of MMF Protection et Sécurité can only be held liable in the event of a proven and exclusive fault in causing the damage.
- MMF Protection et Sécurité cannot be held responsible for indirect damage, such as commercial loss, loss of clientele, loss of profits, damage to brand image or loss of data.
10. Promotional gifts
Eligibility for promotional gifts and offers is based on the net order value, excluding VAT and delivery costs. These offers are only valid while stocks last.
Only one promotional gift may be awarded per order or per customer. Promotional gifts cannot be exchanged for cash. If the item is no longer available, MMF Protection et Sécurité reserves the right to offer an equivalent or superior product.
All promotional gifts become the property of the acquiring company and not of its employees or representatives. MMF Protection et Sécurité reserves the right to request written confirmation from the purchaser that the promotional gifts policy has been complied with.
11. Force majeure
The parties shall not be held liable for failure to meet their respective obligations in the event of force majeure, as defined by article 1218 of the French Civil Code.
In particular, the following are considered to be cases of force majeure: fire, strikes, computer system interruptions, pandemics, transport blockages, import or export bans.
12. Information Technology and Civil Liberties
Any order placed entails the establishment of an automated file in accordance with the provisions of the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (RGPD).
The information collected is essential for order processing and invoicing. Otherwise, the order cannot be validated.
